TERMS & CONDITIONS
In booking a session with Amanda Mortenson Photography (AMP), the client agrees to the following terms:
AMP will provide photography services to the client in line with the selected package (session duration and number of included images). AMP will perform basic post-processing or digital image editing services on these photos where artistically necessary. Beauty edits (e.g. blemish and wrinkle removal, teeth whitening, wardrobe modifications, body shaping, modifications to clothing, etc.) and/or background composites/modifications may incur an additional cost beyond the basic edits included in package. AMP will provide pricing information as requested.
2. Fees and payment schedule: A retainer will be required to finalize booking of your session. Please note this retainer is non-refundable, but can be used toward the cost of a future session within 3 months of the originally scheduled date (package price changes may apply; subject to availability). Reschedule requests are subject to availability and must be made at least 14 days in advance for high demand dates (includes fall mini sessions, holiday mini sessions, and weekend sessions in September-November ) or 3 days in advance (all other sessions) or a $75 reschedule fee will apply. Clients who do not show up for scheduled sessions, or show up after the session time has lapsed, without contacting the photographer will forfeit their full retainer amount toward a no show cancellation fee. Sessions are subject to any applicable price changes that are in place at the time of rescheduling. CLIENT agrees to pay the photographer a non-refundable payment in full (100%) of the total price of the photography services at the time of the SHOOT. If CLIENT does not have payment amount available at the conclusion of the session in an agreed upon form and an invoice must be sent following the SHOOT, the CLIENT agrees to a 3.5% processing fee applied the remaining balance.
3. Work Product: AMP will deliver proofs of photos to CLIENT no more than thirty days (30 days) after the date of the session. The proofs will be available to CLIENT until the final images are selected or up to a maximum of 90 days; if CLIENT does not select final images during this time frame, the proofs will be removed from the proofing gallery and the CLIENT will be charged a $25 archive retrieval fee to access them again (subject to availability). CLIENT understands and agrees that proofs are the exclusive property of AMP and CLIENT has no right to these photos except for permission to produce copies for private and personal use of client. Upon delivery of the proofs, the CLIENT will be entirely responsible for these files; AMP shall not be required to reproduce or replace these files if they are lost, stolen, destroyed or not downloaded from the online proofing gallery within the allotted time.
4. Waiver of liability: By agreeing to a photography session with AMP, CLIENT is waiving, releasing and discharging Amanda Mortenson, Amanda Mortenson Photography and its affiliates from any and all liability. CLIENT agrees to hold AMP harmless for any personal injury, disability, property damage or property theft which may occur as the CLIENT poses or works with AMP. CLIENT will be responsible for their children, pets and themselves and release AMP from any claims against their person or their business. If AMP is unable to perform the services in this contract due to any cause outside its control, client agrees to indemnify AMP for any loss, damage or liability.
5. Model Release: CLIENT grants permission to AMP to use CLIENT’S image or likeness in any and all forms of media for commercial purposes, advertising, trade, personal use, or any and all other uses.
